What the law says, in brief

Law no. 2023-451 of 9 June 2023 regulates commercial influence in France. It requires transparency (the labels “Publicité” or “Collaboration commerciale”, “Image retouchée” and “Image virtuelle”), bans the promotion of certain products and services, and makes the advertiser and the creator jointly responsible. Since 1 January 2026, a written contract is mandatory from €1,000 excl. VAT in fees and gifted products over a year.

In the UK (ASA and CMA), the US (FTC), the rest of the EU, the Gulf or Morocco, the rules differ, but the transparency principle (clearly stating that content is sponsored) applies everywhere. Official text: Law no. 2023-451 of 9 June 2023, on Légifrance. Read also: the €1,000 rule in 2026.
