UGC usage rights: the questions to settle before publishing
The content and how it’s used are two topics to clarify in the same agreement.
Describe the expected usage precisely
State where the brand wants to use the content: website, social media, product page, email, paid ads or physical media. Specify for how long, in which countries and on which accounts. Distribution by the creator and distribution by the brand are two different situations.
This checklist helps you frame the project; it doesn’t replace legal review suited to the country and the contract. In particular, advertising, intellectual property and image rights rules can differ from one market to another.
Plan for future edits
Will the brand be able to cut the video, change the subtitles, translate the voice, add a call to action, extract a still or include the content in a longer edit? Get agreement on these options before producing variations. If a campaign may be amplified later, clarify the terms of that extension now.
Avoid vague wording like “all media, forever” if it doesn’t match the real need or the creator’s agreement. A clear scope also makes pricing and file management easier.
Check the elements that don’t come from the creator
- Music and sounds: rights suited to the planned channel and ad usage.
- People visible or audible: consent needed depending on the situation.
- Identifiable locations, artworks, packaging or third-party brands: check permission or change the shot.
- Product claims: evidence available and category-specific rules.
- Images or clips added to the edit: origin and reuse conditions.
A video can be technically ready and still unusable in the planned campaign if these elements haven’t been checked.
Keep a usable record
Keep the agreement, the deliverables concerned, the validity dates and any extension terms in one place. Link each version to the creator, the channel and the campaign. Before any new distribution, check that the usage stays within the agreed scope.
These points are prepared in the UGC brief, then confirmed in the agreement. If your goal is to move from organic content to paid ads, also see our guide on these two uses.
